EPR requirements in Spain are now in force for Amazon sellers on their marketplace. The policy will impact you if you are a selling partner who is not established in Spain and sells EPR applicable products on amazon.es to customers with a shipping address in Spain, and you are considered a “Producer of Product” within the meaning of the Spanish Regulations.
The list of impacted products and packaging vary from country to country, but now include:
- Germany: Packaging, Batteries and Electrical and Electronic Equipment (EEE)
- France: Packaging, Batteries and Electrical and Electronic Equipment (EEE), Furniture, Papers, Tires, Chemicals, Toys, Textiles, Sporting and leisure goods, Do-it-yourself and gardening articles
- Austria: Packaging, Batteries and Electrical and Electronic Equipment (EEE)
- Spain: Packaging, Batteries and Electrical and Electronic Equipment (EEE)
Selling partners must now provide Amazon with a valid registration number for each category of EPR applicable products (also referred to as “Unique Identification Numbers” or “EPR Registration Number”). If you do not provide Amazon with your UINs, Amazon will, by default, declare and pay the corresponding EPR eco-contributions to the relevant Producer Responsibility Organizations on your behalf and recover these amounts from you.
The EPR requirements in Spain policy includes:
- Steps Amazon will take if you fail to provide your EPR Registration Number
- Clarification that Amazon does not assume EPR organizational obligations (waste prevention plans, eco-design, and etc.)
- Details about the Pay on behalf service fees and charges that apply in case Amazon is required to fulfill EPR obligations on your behalf
- Clarification that Amazon is not acting as your authorized representative
If you do not want Amazon to declare and pay eco-contributions on your behalf, you must provide Amazon with your UIN(s) or stop selling EPR applicable products on Amazon.es.
