From the 5th of August, 2022, a new updated Amazon Services Europe Business Solutions Agreement comes into effect to reflect new regulatory guidance on international data transfers.
For sellers located outside of the European Economic Area (EEA) and the UK, Amazon have introduced a new programme policy that adopts the new European Commission and UK contractual mechanisms. This is known as the Controller to Controller Standard Contractual Clauses (SCCs) and the UK Addendum to the EU SCCs.
This policy covers Amazon’s transfer of EEA and UK Amazon customer information to sellers outside of the EEA and the UK as part of the Amazon services. The updates also provide further clarification on Amazon’s and the seller’s respective obligations under the applicable data protection law when handling Amazon customer information.
There should be no additional action that you need to take to sign or comply with the changes. Sellers receiving customer information should already be handling it in accordance with the high standards of protection expected of sellers and in line with applicable data protection law. However, Amazon still advise you to familiarise yourself with the changes and take this opportunity to review the data handling processes you have in place to ensure you remain compliant.
No specific acceptance of the data transfer policy is needed as your continued use of selling services after August 5, 2022, constitutes your acceptance of the changes.
