New rules for selling medicines on eBay UK

UK EU Common LogoeBay UK have announced that From 1 July 2015, if you sell any medicines online, you must be registered with the Medicines and Healthcare Products Regulatory Agency in the UK as well as displaying an EU common logo.

This is apparently a requirement of the Human Medicines Regulations 2012, which implements the Falsified Medicines Directive.

Additionally registered pharmacies can sell general sales list medicines, pharmacy only medicines or supply medicines that they have dispensed against a prescription. All other general retailers can only sell general sales list products and that probably means that’s all anyone can sell on eBay as it’s unlikely you can check a prescription on eBay.

Quite how this will work on eBay I’m not sure. If a buyer is using a mobile app the only place they’re likely to see the EU common logo is in the gallery images, but there it won’t be hyperlinked. The only logical place is to pop the logo in your description. The good news is that you won’t be breaking the which has an exception allowing “Links to sites and content of government websites in accordance with the law, for example if you offer for sale General Sales List medicines”.

There are currently over 14,000 general over the counter products on eBay, so that’s 14,000 listings currently in violation of the updated eBay which came into effect yesterday.
